De guardianes de derechos a cómplices del terror. Dictadura, poder judicial y justicia transicional en el Comahue

Abstract

Este artículo examina el modo en que se articuló la complicidad judicial con el terrorismo de Estado en la región del Comahue durante la última dictadura cívico-militar argentina (1976-1983), así como los mecanismos sociales e institucionales que se desplegaron para enfrentarla. A partir del estudio del caso de la Subzona Militar 5.2 —que abarcó la totalidad de la provincia de Neuquén y buena parte de la provincia de Río Negro—, se analizan las estrategias de reconfiguración del poder judicial implementadas por el régimen autoritario para asegurar la cobertura legal de la represión y garantizar la impunidad de sus crímenes. Al mismo tiempo, el trabajo reconstruye las respuestas sociales construidas frente a estas prácticas, tanto las acciones impulsadas por víctimas, familiares y organismos de derechos humanos durante la dictadura, como las iniciativas promovidas en democracia para revertir la impunidad y llevar a juicio a los responsables, incluyendo a funcionarios judiciales. Basado en fuentes judiciales, archivos históricos, testimonios e informes de organizaciones de derechos humanos, el estudio se propone contribuir a una comprensión situada de las relaciones entre poder judicial, dictadura y democracia, y a reflexionar sobre los desafíos de construir una justicia transicional que amplíe los márgenes de responsabilidad institucional frente a crímenes de Estado.

State terrorism was articulated in Argentina’s Comahue region during the last civil-military dictatorship (1976–1983), as well as the social and institutional mechanisms that emerged to confront it. Focusing on the case of Military Subzone 5.2, which included the entire province of Neuquén and a large part of the province of Río Negro, the article analyzes the strategies deployed by the authoritarian regime to restructure the judiciary in order to provide legal cover for repression and guarantee immunity for the crimes committed. At the same time, it traces the responses given by victims, their relatives, and human rights organizations, both during the dictatorship and in the post-dictatorship period, aimed at challenging impunity and bringing those responsible to justice, including members ofthe judiciary. Based on judicial sources, historical archives , testimonies, and human rights reports, this study seeks to contribute to a situated understanding of the relationship between the judiciary, dictatorship, and democracy, and to reflect on the challenges of building a transitional justice framework that expands its scope to ensure institutional accountability for State crimes.
